The National Labor Relations Act is the law governing relations between unions and employers in the private sector. The function of the Regional Office of the National Labor Relations Board is to investigate unfair labor practice charges filed against employers and unions and, where merit is found, to prosecute the case before an administrative law judge. Additionally, the Regional Office processes representation petitions, holding hearings and elections, and writing decisions regarding unit issues.
The Peggy Browning Fellow will work closely with a supervisor or manager in the Regional Office and perform a wide range of assignments related to NLRB Region 5’s administration of the Act. The Fellow will spend a short period of time observing the Region’s professional staff, including field attorneys and/or field examiners, performing their case-handling responsibilities. These activities include investigating unfair labor practice charges, and the Peggy Browning Fellow will quickly be assigned his/her own caseload of unfair labor charges for investigation.
Investigating charges entails contacting the charging party and taking affidavits from their witnesses, contacting the charged party and securing their response to the charge, performing legal research, and reporting on the merits of the case to the supervisor. In certain cases, after writing a final investigative report, the Peggy Browning Fellow will report the case to the Regional Director at a regional “agenda” meeting. The Fellow will also draft agenda minutes, dismissal letters, unfair labor practice complaints, and attend unfair labor practice trials and settlement conferences.
The Fellow will, where possible, observe and participate in election agreement negotiation sessions and pre-election representation hearings, as well as help run representation elections. In addition, the Fellow will perform a wide variety of research and writing assignments related to Board or Court law and procedure, including drafting of pleadings and motions and assisting in research projects in complex or novel areas of the law.
Applicants for a Peggy Browning Fellowship with Region 5 will need to have general knowledge of the National Labor Relations Act.
The total ten-week stipend for this fellowship will be $4,500.
