JOB DESCRIPTION
The Comptroller’s Bureau of Labor Law enforces New York Labor Law Articles Eight and Nine, New York Real Property Tax Law § 421-a and New York City Administrative Code §6-109. The Bureau also performs wage investigations under New York City Administrative Code §§ 6-130 and 6-134. These laws require employers that are parties to New York City government contracts and property owners that receive property tax exemption benefits to pay no less than the prevailing wage or living wage to their employees for work covered by the statutes, as determined by this Bureau.

The Attorney will represent the Bureau of Labor Law in administrative proceedings to enforce prevailing wage laws that cover workers in the construction and building service industries and living wage laws that cover all employees of employers subject to the laws. Responsibilities include, but are not limited to, the following:

  • Assists with preparation of cases for settlement and/or administrative trials;
  • Negotiates settlements and drafts stipulations of settlement;
  • Represents the Comptroller in administrative trials at the Office of Administrative Trials and Hearings (OATH);
  • Performs legal research concerning enforcement of New York Labor Law Articles Eight and Nine, New York Real Property Tax Law §421-a and New York City Administrative Code § 6-109;
  • Drafts legal memoranda and post-hearing memoranda concerning enforcement of New York Labor Law Articles Eight and Nine, New York Real Property Tax Law §421-a and New York City Administrative Code § 6-109; and,
  • Performs other related work or special projects as directed.

MINIMUM QUALIFICATION REQUIREMENTS
Admission to the New York State Bar and two years of progressively responsible experience performing complex and significant legal work subsequent to admission to any bar, preferably in the nature of what is listed in the bulleted list of the above job description.

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

PREFERRED SKILLS IN ADDITION TO MINIMUM QUALIFICATIONS

  • Experience conducting litigation, providing legal advice, appearing in court, and negotiating settlements with opposing parties;
  • Expertise in local, state, and federal labor and employment laws;
  • Excellent interpersonal, communication, and organizational skills;
  • Strong writing, research, and analytical skills;
  • Comfort with analyzing data in payroll records and Excel spreadsheets;
  • Ability to effectively advise and interact with team comprised of investigators, auditors, and engineers.
